Terms of Service

Welcome to Weiwen Tech Co., Ltd. (偉雯科技有限公司, Tax ID 97549948; "Weiwen Tech", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our websites, mobile applications, and related services (collectively, the "Services"), including but not limited to weiwentech.app and the eatmoji application. By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. By using the Services, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your Account

Some features require you to create an account. You agree to provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for all activity on your account. Notify us immediately at support@weiwentech.app if you suspect unauthorized use.

3. Subscriptions and Purchases

Certain features are offered via paid subscription or one-time purchase, processed through Apple App Store or Google Play. Pricing, billing intervals, and renewal terms are shown at the point of purchase. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period through your platform's subscription settings. Refunds are governed by the policies of Apple or Google, not by us.

4. Acceptable Use

You agree not to:

• Use the Services to violate any law or third-party right;
• Reverse engineer, decompile, or extract source code from the Services;
• Use automated means to scrape, copy, or harvest data;
• Interfere with, disrupt, or attempt to gain unauthorized access to any part of the Services;
• Upload content that is illegal, harmful, infringing, defamatory, or that you do not have the right to share;
• Use the Services to develop a competing product.

5. User Content

You retain ownership of the content you submit to the Services (such as meal photos, notes, and entries). By submitting content, you grant Weiwen Tech a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display such content solely for the purpose of operating and improving the Services. We may use de-identified, aggregated data to improve our models and features.

6. AI Features and Health Disclaimer

Our Services include AI-generated estimates such as nutrition values, calorie counts, and dietary suggestions. These estimates are provided for informational and educational purposes only and are not medical advice. Accuracy is not guaranteed. Do not rely on the Services for the diagnosis or treatment of any medical condition. Consult a qualified healthcare professional before making significant changes to your diet, exercise, or medication.

7. Intellectual Property

The Services, including all software, design, text, graphics, and trademarks, are owned by Weiwen Tech or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes, subject to these Terms.

8. Third-Party Services

The Services may integrate with or link to third-party services (such as Apple, Google, Firebase, or payment processors). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party content or services.

9. Termination

You may stop using the Services at any time and delete your account from within the app. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will do so.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or accurate.

11. Limitation of Liability

To the maximum extent permitted by law, Weiwen Tech and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50.

12. Indemnification

You agree to defend, indemnify, and hold harmless Weiwen Tech from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your content, or your violation of these Terms.

13. Changes to the Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you in-app or by email. Your continued use of the Services after the changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of Taiwan (R.O.C.), without regard to its conflict-of-law principles. Any dispute will be resolved in the competent courts of Taipei, Taiwan, unless mandatory local law provides otherwise.
